Terms and Conditions
1. Scope of Work
Hepworth Timber Work will provide the following services to the Client:
- Design and construction of all Garden rooms, Timber structures, Fencing or Decking
- Supply of materials
- Installation of the all Garden rooms, Timber structures, Fencing or Decking
- Any other services as agreed upon in writing by the Client and Hepworth Timber Work
2. Pricing
The price for Hepworth Timber Work’s services will be as agreed upon in writing by the Client and Hepworth Timber Work. The price will be based on the scope of work, the materials used, and the labour required.
3. Payment Terms
The Client will pay Hepworth Timber Work in full upon completion of the work. Hepworth Timber Work may require a deposit to be paid before work begins.
4. Changes to the Scope of Work
Any changes to the scope of work must be agreed upon in writing by the Client and Hepworth Timber Work. Any changes to the scope of work may affect the price of the project.
5. Scheduling
Hepworth Timber Work will use its best efforts to complete the project within the agreed-upon timeframe. However, Hepworth Timber Work is not responsible for delays caused by factors beyond its control, such as weather or acts of God.
6. Warranties
Hepworth Timber Work warrants that its work will be free from defects in materials and workmanship for a period of one year from the date of completion. Hepworth Timber Work will repair or replace any defective work at no charge to the Client.
7. Limitation of Liability
Hepworth Timber Work’s liability for any damages arising out of or in connection with this Agreement shall be limited to the amount of the fees paid by the Client to Hepworth Timber Work. Hepworth Timber Work shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, loss of use, or loss of data.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of United Kingdom
9. Entire Agreement
This Agreement constitutes the entire agreement between the Client and Hepworth Timber Work with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
10. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement and the remaining provisions shall remain in full force and effect.
11. Waiver
No waiver of any provision of this Agreement shall be effective unless in writing and signed by both parties.
12. Notices
All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United Kingdom mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

or to such other address as either party may designate in writing from time to time.
13. Headings
The headings in this Agreement are for convenience only and shall not affect its interpretation.
14. Counterparts
This Agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
